I refer to your email regarding dark lamps on Calderpark Avenue.

 

These lights are dark due to the current construction work by undertaken by Ferrovial Lagan JV for the M8/M73/M74 improvements which incorporates the A721 Daldowie Roundabout. I have advised them of this fault  requesting that they restore the lighting as a matter of urgency.

Cllr Turner has asked that I contact you to express his dissatisfaction regarding the undernoted response.

 

He indicated that it is not good enough given that the best part of 6 months has gone by and nothing has been done – by leaving this until December and then allowing water to flow onto the road during very cold temperature may cause accidents in the area.  Cllr Turner would appreciate for pressure if applied to Miller Homes to have this work completed asap.

I refer to your undernoted email and can advise that my officer, met with a representative from Miller Homes on 11 November 2016 to discuss the water runoff from the embankment opposite No.10 Baillieston Road. Miller Homes have accepted that a solution requires to be found and have advised that a filter trench will be installed to remove the water being discharge at this location. They have advised that they will endeavour to have the works undertaken by 30 November 2016.

Thank you for your undernoted email.

 

I can advise that my officer visited 2 Baillieston Road and observed the pedestrian/traffic flows in that area.  His initial observations were that this location would not meet Glasgow City Council’s criteria for the provision of a controlled crossing due to insufficient pedestrians crossing the carriageway.

 

The criteria for the installation of a controlled crossing is based on a number of factors. These include the measure of potential conflict between traffic and pedestrians at the proposed crossing point, accident history, speed of traffic, geometry and sight lines.

 

Examination of Police Scotland’s latest available injury accident records has revealed that there has been no recorded accidents in the standard three year period ending 30 July 2016.

 

Whilst I sympathise with the concerns, I regret to advise, that I am unable to install a controlled

crossing at this location at the present time.”

Thank you for your enquiry regarding early years provision in the Garrowhill / Baillieston / Broomhouse area.  I can confirm that all of the families who were accessing places at Bannerman Beavers Playgroup have been found alternative places for the start of term in August at another of our partner services, Indigo Garrowhill Nursery.

In relation to further developments, as you may be aware, the Scottish Government has announced a major expansion programme for early learning and childcare, which will see the early years sector almost double its capacity over the next four years.  The entitlement to nursery provision currently sits at 600 hours for all 3 and 4 year olds and for some 2 year olds, however, this entitlement will increase to 1140 hours by 2021.

A very significant transformational change programme will be required to deliver this nationally and locally and we are already working on our local change programme.  Scottish Futures Trust are leading the capital expansion work in partnership with local authorities and we are at the early stages of scoping out with them, our requirement to develop new build nurseries or to extend or refurbish existing accommodation.  No firm plans have been made yet for the Ward 20 area but the expansion programme will consider all areas across the city and will take account of new housing developments which may generate higher demand.

It is likely to be early in 2017 before a final capital expansion programme is agreed and the funding signed off at national level.  I would be happy to provide an update at that stage.

I refer to your recent email and can respond as follows.

 

I can advise that the existing speed humps that are in place throughout the area were installed as part of the agreed development proposals.

 

As previously advised, to conform with the Traffic Signs Regulations and General Directions (TSRGD) 2002, Mandatory 20mph Zones must have traffic calming measures (such as speed humps, speed tables, chicanes, etc,) installed within 50m of an entry point and then every 100m.  Sharp bends can also count as a form of traffic calming.

 

I refer to the recent Transport Scotland document titled the ‘Good Practice Guide on 20mph Speed Restrictions’.  According to this document, 20mph Limits can now be considered without traffic calming measures at locations where the ‘existing mean speeds are no greater than 24mph’.

 

This extremely positive change in regulation will result in residential areas with no physical traffic measures in place and where vehicle speeds are 24mph or below, being implemented as Mandatory 20mph Zones without the need for ‘traditional and costly’ traffic calming measures such as speed humps.

 

Therefore, as this area already has the required physical traffic calming measures in place and due to the guidance that 20’s roundels are now classed as prescribed traffic calming measures, it would not be our intention to introduce any further physical traffic calming measures in this area.

 

However, due to the concerns raised, if the scheme is given approval and is implemented, I will arrange for a speed radar to be erected at the location your constituent has speeding concerns over in order to monitor vehicle speeds. These results will then be assessed to determine vehicle speeds.

Heavy Construction Traffic Broomhouse Crescent

“Dear Councillor Turner,

 

I refer to the emails form your office concerning the above.

 

Following your enquiry, we once again contacted Miller Homes on this matter, they have advised that the existing road is being utilised for timber frame deliveries only and that they are currently providing a road brush to ensure that the carriageway is kept clear at all times.

 

There are approximately 8 plots of timber frame to deliver to site and after that all deliveries / traffic will be taken through the spine road.

 

Given the nature of the construction process this, although not ideal, does appear to be reasonable given the scale of development.

 

As previously intimated Broomhouse Crescent is currently a private road and is the responsibility of Miller Homes. Should your constituent experience construction vehicles other than the above, I would be happy to take this up with the developer once again.”

Constituents complaints over Parking on Baillieston Road, Broomhouse – Response from LES

Dear Councillor Turner

 

I refer to your undernoted email regarding a request for waiting restriction on Baillieston Road.

 

I can advise that the Council does not have delegated powers to simply introduce a regulatory measure on a road, like yellow no waiting lines.  The Local Authorities’ Traffic Orders (Procedure) (Scotland) Regulations 1999 prescribes the formal legal process that allows the making of a Traffic Regulation Order (TRO).  This involves initial consultation with the emergency services and certain road user groups like the Freight Transport Association.  The local Elected Members are also consulted at this early stage.  The wider community is included in the second stage consultation, where the proposal is advertised in a local newspaper and is open to objections.  For this reason, such restrictions would require the support of the local residents.

 

It should be noted that the full process can take between 9 and 12 months to complete and requires significant staff resources.  In view of this, it is more efficient to include any minor proposals as part of a wider area traffic management plan.  I will, therefore, arrange for these proposed restrictions to be added to the TRO ‘wish list’ for the area on the premise that they will be incorporated in a larger area order once there is enough work to justify the promotion of such an Order.

 

Notwithstanding the above, I can advise that, although parking on the pavement is not in itself an offence, it is an offence if an actual obstruction is caused.  Please note that the police do not consider the offence of obstruction to be committed unless there is an actual physical blockage of the footway, preventing pedestrians to pass without stepping onto the carriageway.  Only the police can enforce the offence of obstruction, Council parking attendants do not have any powers to do so.  The advice from the Road Traffic Police is that any incidence of obstruction should be reported to the local police at the time the offence occurs.  They may take action according to their own priorities and available resources.”

further steps eg wheel cleaning and dust suppression are taken to prevent excessive dust and dirt affecting the roads and surrounding area.

I refer to the undernoted email regarding fly tipping in the Broomhouse area.

 

The used tyres have been dumped in an area that is now closed off and under control of the contractor developing Boghall Road.

The contractor has been asked to remove the tyres as soon as possible.

 

A visit to the site of the Doo Cot indicated that there was still a large accumulation of refuse present to the west of the Doo Cot.

The owner of the area,  was contacted and advised that he should act to remove it immediately.

He apologised for his inaction but indicated that it should be cleared with the next week or two.

A further visit will be made next week and should there be no action, Operations will be instructed to visit and clear the area in

default of the notice served.

The owners will be invoiced for the work carried out thereafter.

I will arrange for a covert speed survey to be carried out on this section of road and will advise Police Scotland of the results, should the average speed exceed the permitted speed limit.  However, it should be noted that the two radars available to this Service are in constant use city wide and it will be August before the survey can be undertaken.

 

In addition to the above, I am pleased to advise that, in the most recent 3 year period, there have been no injury accidents recorded on this section of road.

Firstly, may I thank your constituents for providing me with this further information.    Information from members of the public is paramount to the success of the Clean Glasgow campaign.  Members of the public can report irresponsible dog owners and instances of dog fouling direct by telephoning 0300 343 7027.

 

As a result of the information provided, I can advise you that my dog fouling Enforcement Officers will continue to be deployed to the streets listed by your constituents in order to issue Fixed Penalties to those persons observed committing offences.

 

In addition, I have highlighted your concerns to my colleagues in LES. They may consider additional signage, however our colleagues in Public Health would be able to advise about any alternatives available, bin provision and or a mechanical sweep of the area.  I have asked them to respond to you directly with their findings.

SITE: SITE FORMERLY KNOWN AS GLASGOW ZOO 1 CALDERPARK,  GLASGOW  

FELLING OF TREES

I refer to your communication in respect of this matter.

I would advise that a review of the granted planning application (reference number 14/02964/DC) confirms that a tree survey was submitted by the developer as required and that tree felling was subsequently agreed to include invasive species of trees and those trees with a limited life span. It was also agreed that compensated tree planting would take place as a result.

 

However, this review of the granted planning application decision notice confirms the imposition of a condition requiring that any felling or cutting back of trees, scrub or bushes shall be undertaken outside the main bird breeding season (March-July inclusive), unless a survey confirming that no nests could be damaged,  destroyed or obstructed.

 

As such, this matter will now be fully investigated and any necessary action will be taken to ensure that any trees felled are as approved and comply with this condition. A site visit has been scheduled for the relevant officers to decide what actions may be required in the circumstances.

Thank you for your enquiry concerning the above.

 

The proposal to develop a community facility in Baillieston is linked to wider housing developments as part of the developers Section 75 commitments. This is to provide a range of interventions such as improvements around the station, to road access and the community facility. Amounts payable are determined by housing completions, and is therefore linked to the rate of development of the site as to when funding will be available for the interventions as outlined.

 

With regard to other funding options(Robertson Trust etc.) this would likely only be available as top up funding for enhanced services at a new facility and not the core funding to allow progress at present.

 

We would suggest that DRS are the best point of contact for updates on the progress of the Community Growth area plans.

ENV2/COMMUNITY GROWTH BAILLIESTON

 

I refer to the above.

 

Since my response of 21st June 2016, I can confirm that Miller Homes has fulfilled their community growth contribution (approximately £660,000) and ENV2 contribution (£150,000) with respect to the development of the former Glasgow Zoo site (10/00345/DC).

 

Furthermore, Miller’s has paid the ENV2 contribution (£40,000) linked to one of their phases in the Ellismuir Farm site (14/01481/DC); the community growth payment has not yet been made because the houses are still under construction.

 

Persimmon Homes has intimated that they are about to make their first ENV2 instalment (£66,944) and community growth payment, which will be dependent upon levels of sales, with respect to the Bredisholm site.

 

I am advised that there appears to be no records of either Taylor Wimpey or Bett Homes making payments; I have contacted both parties and will respond once I have clarified this.

COMMUNITY HUB – JAMES LINDSAY PARK

 

I refer to the above and apologise for the delay in responding.

 

I understand that the sports hub will be paid from community growth monies from the Zoo/Ellismuir Farm (10/00056/DC – Miller Homes) and the Bredisholm Road (10/00328/DC – Persimmon) planning permissions and secured through legal agreements, rather than through the use of ENV3 funding

.

The community growth monies are also intended to bring forward a bridge over the railway, which connects the Persimmon development with the larger Miller Homes site, improved library services in Baillieston, parking at Baillieston Station, as well as the hub at James Lindsay Park.  The total cost of community benefits is approximately £12 million with the hub costing £7 million.

 

To date, I understand that land has been transferred from Persimmon Homes to the Council to extend the James Lindsay Park, and monies are coming in through the community growth programme from the respective development areas.  The legal agreement levies a sum of £11,000 on each unit completed; Persimmon are allowed to build 59 houses prior to making the first payment to acknowledge the land transfer.

 

Whilst I anticipate the monies for the hub still being well short of its costing, I have asked colleagues elsewhere in the Council to provide me with the sums collected to date, and will advise further once I am in receipt of that information.
